What is wrongful death?
Any death that occurs as the result of another person's negligence is termed a wrongful death.

What if someone else's actions caused a death, but the actions were unintentional?
If they are proven to be negligent, it doesn't matter if their actions were intentional or not. If they failed to exercise the proper foresight a reasonable and prudent person would have exercised in a similar situation, then they are considered liable in a court of law.

Who can file a wrongful death claim?
Any surviving immediate family member. Typically, this is limited to children, spouses, siblings and parents. Although, in some cases, stepchildren and non-adopted dependant youths living in the household may also file claims.

What sort of compensation can I receive?
It depends on the situation. Generally, the deceased's projected future earnings are calculated, and then divided proportionally by the number of dependants. Compensation varies, however, based on how the person died. Additionally, punitive damages for pain and suffering can be awarded.
