Who is Liable For Premises Liability?

A person who owns any facility which others enter is responsible for keeping it safe. This includes owners of:
  • Private homes
  • Rental properties
  • Government-owned facilities
  • Hotels
  • Stores and restaurants
  • Commercial and office buildings

Such owners are required to use reasonable care in property maintenance, and if they fail in that and somebody is injured, they can be held liable. Others may also be held liable, such as apartment building managers, store owners who may not own the building their store is in, hotel managers and cleaning or yard work companies.

That liability circle may even be widened to include architects if a design defect is found in a building, construction companies if substandard work is found, plumbers or electricians if faulty work is related to an injury, and any other parties who are found to have contributed by their negligence or carelessness to an accident.

Be the Best Bike Rider You Can

If you love riding a motorcycle, then probably no warnings and no statistics are going to stop you. It's exhilarating like skiing or sailing or riding a roller coaster, and even more so when you wear no helmet or heavy clothing.

So the best strategy is to get very good at it for your own safety. Do everything you can to prevent any motorcycle accidents. Perhaps you are doing or have done these things already, but if not, consider these suggestions:
  • Be meticulous about keeping your bike in good order
  • Test the brakes on different road surfaces to see how quickly they can stop
  • Discover exactly how far you can lean into a curve without any bike parts touching the ground
  • Watch at all times for where each other vehicle is around you and what they are doing. Be proactive about this, since some of them cannot see you very well, or at all.
  • Follow all rules of the road and if you cross state lines, be aware of any changes in the law. An example would be that some states allow you to share a lane with another rider and others don't.
  • If you carry a passenger, make sure that person knows to sit still and not upset the bike's balance
  • Do wear a helmet even if it isn't required by law. And wear protective clothing. A fall can be so damaging to the skin if it's unprotected, and helmets have been proven to reduce head injuries. They don't necessarily protect the neck or spine, but at least they protect the brain

Truck Accidents Can Be Catastrophic

Over recent years, both the government and truck companies have pulled out all the stops to try and cut back on truck accidents.
