Emergency Room Medical Malpractice Can be Most Disastrous

According to the Journal of the American Medical Association (JAMA), the number of people dying from medical malpractice each year in the United States is growing. Medical malpractice deaths have become the third leading cause of death in the United States according to JAMA, after heart disease and cancer. Malpractice occurs frequently and patients are treated inadequately, especially in our nation's emergency rooms.

Emergency rooms are designed to treat a large number of people with a wide range of medical problems ranging from common ailments, such as the flu, to life-threatening injuries, such as gunshot wounds and open head injuries. We tend to believe that if we go to an ER or are taken to one by an ambulance, we will be evaluated fairly quickly and be seen by an experienced ER physician and ER staff. That is not always the case.

Even though ER staff are trained to work in a fast-paced environment and treat patients efficiently, our nation's ER's have become busier and busier, and even the most highly-trained ER specialists cannot keep up with the demands of the patients.

For this reason, some patients wait several hours to be seen. Understaffed ERs are also a huge problem in this country; sometimes there simply are not enough nurses and doctors in the ER to treat all of the patients in a timely manner.

Due to the nature of some ER patients' injuries and illnesses, ER mistakes can cause serious injury and even death. Some patients get so frustrated with the long wait they have experienced at an ER that they may just leave without having been evaluated by a doctor at all. The patient's frustration and inability to wait any longer can certainly lead to further sickness after they leave the ER.

The most common types of emergency room errors are:
  • Late or wrong diagnosis
  • Filure to fully evaluate/treat a patient's condition
  • Prescribing incorrect medication
  • Faulty or incomplete laboratory testing
  • Contaminated blood transfusions
  • Failure to adequately monitor a patient while in the ER
  • Not getting a complete medical history/drug allergy information

Legal Help is Almost Always Needed Following a Motorcycle Accident

All motor and road accidents can be nasty, but motorcycle accidents can result in particularly serious personal injuries. Motor accidents are the leading cause of death between 6-33 year olds in the United States, and when it comes to motorcycle accidents around 3,000 cyclists are killed each year. Many others are severely injured and undergo serious life changes and disabilities due to motorcycle accidents. As far as statistics go, in most cases a motorcycle accident is not actually the fault of the motorcyclist but of the driver of the car, van, truck, or other vehicle. In a large percentage of cases, the other driver was simply unable to see the motorbike, however, this does not excuse them from blame.

Motorcycle accidents often result in very serious injuries or death, and it is therefore important for those involved in a motorcycle accident to contact an experienced lawyer in order to recover costs for injury, distress, loss of wages, medical expenses, and other damages caused as a result of the motorcycle accident. It is also important to take certain steps immediately following the accident whenever possible. Of course, this may not always be possible, as the accident could result in too serious an injury or unconsciousness.

If you are the relative of someone who has been killed in a motorcycle accident, it is also important to seek legal representation right away in the event that the fault was the other driver’s. There are many lawyers that specialize in motorcycle accident claims, and it is best to seek assistance from a lawyer with expertise and a good deal of experience in this area. You can usually set up a free initial consultation to discuss the various legal options available to you.

Attorneys at the Glick Law Firm, P.A. in Boca Raton, Florida will advise you regarding your legal rights following a motorcycle accident. Please call or email the Glick Law Firm, serving clients in Boca Raton, Ft. Lauderdale and West Palm Beach, today to schedule your free initial consultation.

What to do After a Truck Accident

Truck accidents (semi-trucks, vans, dump trucks, fire trucks, and tractor trailers) account for over 20 billion dollars a year in damages, according to the Federal Motor Carrier Safety Administration. With so much money on the line, it's easy to see why trucking and insurance company personnel arrive on the scene of a trucking accident so quickly. These industry representatives are collecting statements, pictures and information to protect the legal and monetary interests of their clients.

If you have ever been in an auto accident, you may think you know what to do in the even of a truck accident. What you might not know is that trucking accidents are different than automobile accidents because of federal laws governing the trucking industry. For example, federal trucking regulations require that evidence must be maintained but only for a limited amount of time. This means evidence pertaining to your accident can legally be destroyed after six months if an attorney doesn't obtain a court order and take immediate action.

If you are involved in a truck accident, it is imperative to understand the steps you should take to protect yourself.

Obtain the following information:

  • A copy of the police report
  • License plate number of the truck
  • Any names or identification on the cab and trailer
  • Driver information including name, license number, and all contact and insurance information
  • Insurance information for truck owner
  • Length of skid marks (if possible)
  • Condition of truck
  • Names and info about any witnesses

In addition to gathering the above information, you should:

  • Take photographs if possible
  • See a medical doctor for examination as soon as possible
  • Obtain a copy of your medical report
  • Contact a truck accident attorney

Do not give any statements without first talking to your attorney, and do not sign anything without first talking to your attorney.

If you would like to learn more about what you should you do if you’re in a truck accident, or if you’ve been injured in a truck accident in South Florida and would to speak to an experienced truck accident attorney, please contact the Glick Law Firm, P.A. serving residents in Boca Raton and south Florida.
